1. In a matter of national security, I’m sure the trial could take precedence and be fast tracked. You can’t crime your way out of prosecution by running for office.

2. Section 3 of the 14th Amendment states that no one can “hold any office, civil or military, under the United States, or under any State” if they took an oath to support the Constitution and then “engaged in insurrection or rebellion against the same.” It’s quite possible that Trump could be charged with inciting an insurrection.
